XenonFlare provides an autonomous content studio allowing users to manage, schedule, and distribute video and image content to platforms including YouTube, Instagram, TikTok, LinkedIn, and Pinterest. The service includes cloud storage, AI-assisted tools, and automated publishing capabilities.

3. User Responsibilities & Content

• Ownership: You retain all rights to the content you upload. You grant XenonFlare a limited, non-exclusive license to process and distribute your content as necessary to provide the service.
• Legality: You must own or have the necessary licenses for all content. You are solely responsible for ensuring your content does not violate any third-party rights or laws.
• Account Security: You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

4. Privacy & Data Handling

Your privacy is extremely important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy.

• We process your data primarily to provide and improve the Service.
• We do not sell your personal data to third parties.
• Data shared with third-party platforms (YouTube, Meta, etc.) is handled according to your explicit commands and the respective platform's terms.
• Security procedures are in place to protect the confidentiality of your data.

5. Prohibited Uses

You agree not to:

• Use the service for any illegal or unauthorized purpose.
• Attempt to hack, decompile, or disrupt the service infrastructure.
• Engage in automated scraping or data extraction.
• Post content that is defamatory, obscene, or promotes hate speech.
• Violate the Terms of Service of any platform linked to XenonFlare.

6. Platform Integrations & Compliance

XenonFlare integrates with third-party APIs. By using these integrations, you are also bound by their respective terms:

• YouTube: You agree to the YouTube Terms of Service and Google's policies.
• Instagram: You agree to Meta's Terms of Service.
• TikTok: You agree to TikTok's Terms of Service.
• LinkedIn: You agree to LinkedIn's User Agreement.
• Pinterest: You agree to Pinterest's Terms of Service.
• Meta Tracking: We use Meta Pixel and Meta Conversions API (CAPI) to track user actions on our website. By using XenonFlare, you acknowledge that certain usage data and normalized identifiers may be shared with Meta for advertising optimization.
• Analytics: We use Google Analytics to monitor and analyze the use of our Service. By using XenonFlare, you acknowledge that your usage data will be processed by Google in accordance with their privacy practices.

XenonFlare is not responsible for any account suspensions or actions taken by these third-party platforms.

7. Intellectual Property

The XenonFlare name, logo, software code, and UI/UX design are the exclusive property of XenonFlare. You may not reproduce, distribute, or create derivative works of our platform without explicit written permission.

8. Payments & Cancellation

Subscriptions are billed in advance. All sales are final. Because we provide immediate access to cloud processing and digital resources, we do not offer refunds. You can cancel at any time via your dashboard settings, and you will retain access until the end of your current billing cycle.

9. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

10. Disclaimers & Limitation of Liability

XenonFlare is provided "AS IS" and "AS AVAILABLE". We make no warranties regarding service uptime or result accuracy.

To the maximum extent permitted by law, XenonFlare shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profit) resulting from your use of the service.
